LANDSCAPE DESIGN SERVICES AGREEMENT

This Landscape Design Services Agreement (“Agreement”) outlines the general terms and conditions under which Al Mutakabbir LLC (“Designer”) provides professional 3D landscape design services to its clients (“Client”). Specific project details, pricing, scope, and revisions are determined based on the design package selected by the Client.

1. SCOPE OF SERVICES

The Designer provides 3D landscape design services only. Services may include, but are not limited to:

1. Planting plans

2. Hardscape concepts (such as patios and walkways)

3. Outdoor living layouts

4. 3D renderings and visualizations

5. Video walkthrough renderings (if included in the selected package)

The exact scope of work, deliverables, timeline, and inclusions are defined by the design package selected at the time of booking.

Any services requested beyond the selected package scope may require additional fees and written approval.

2. FEES & PAYMENT

All design fees are based on the selected package and are communicated prior to the start of work.
Payment is due in full before design work begins unless otherwise stated in writing.

Consultation fees, if applicable, may be credited toward the design fee should the Client proceed with services.

3. REVISIONS

Each design package includes a defined number of revisions within a specified time frame (typically 30 days).
Revisions requested beyond the included amount or outside the revision period may incur additional fees.

4. DESIGN OWNERSHIP & USAGE

Upon full payment, the Client is granted the right to use the final design for the intended project location only.

The Designer retains full ownership of all design concepts, renderings, and intellectual property and reserves the right to use completed work for portfolios, marketing, social media, and promotional purposes.

5. NO INSTALLATION OR CONSTRUCTION SERVICES

The Designer does not provide construction, installation, permitting, engineering, or contractor services.

All designs are conceptual and visual in nature. Final execution, measurements, code compliance, and permits are the responsibility of the Client and their chosen contractors.

6. THIRD-PARTY VENDORS & CONTRACTORS

Any contractors, vendors, or service providers recommended by the Designer are independent third parties. The Designer is not responsible or liable for their work, pricing, performance, timelines, or outcomes.

The Designer does not act as a mediator or representative between the Client and any third party.

7. LIMITATION OF LIABILITY

The Designer shall not be held liable for construction errors, cost overruns, delays, material availability, contractor performance, or site conditions.

The Designer’s total liability, if any, shall be limited to the total design fees paid by the Client.
In no event shall the Designer be liable for indirect, incidental, or consequential damages.

8. TERMINATION

Either party may terminate services with written notice.
If terminated after work has begun, the Client remains responsible for payment of all work completed up to the termination date.

9. INDEPENDENT CONTRACTOR

The Designer is an independent contractor and not an employee, partner, or joint venturer of the Client.

10. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois.

11. ENTIRE AGREEMENT

This document represents a general reference agreement. Specific project details are governed by the package selected and any written confirmations or invoices issued by the Designer.

By engaging services and submitting payment, the Client acknowledges and agrees to these terms.

12. CONSULTATION & TRAVEL FEES

An on-site consultation may be required for certain projects and includes site analysis, photography, measurements, and design planning.

For locations within one (1) hour driving distance from the Designer’s office, a flat consultation fee of $100 applies. This fee is due prior to the scheduled visit and may be credited toward the final design fee if the Client proceeds with design services.

Projects requiring travel beyond one (1) hour, including out-of-state travel, will incur additional fees. Any costs related to extended travel—including but not limited to mileage, airfare, lodging, ground transportation, and travel time—shall be fully covered by the Client. Travel fees for extended or out-of-state projects will be quoted and approved in writing prior to scheduling.

The Designer reserves the right to require advance payment for all consultation and travel-related expenses.
